Terms of Service

These terms are an agreement between you and MBERG LLC, a Florida limited liability company ("MBERG", "we"). They apply when you use the MBERG app or our doorstep trash service. If you don't agree, don't use the service.
1. Who can use MBERG
You must be at least 18 and live in the apartment you sign up for. One account per person; keep your email secure, because sign-in codes are sent there. Staff accounts are separate and use a different email.
2. The service
We collect tied household trash bags from your bin by your apartment door on Monday, Wednesday and Friday nights, 7–9 PM, and carry them to your community's own dumpster or compactor. There are two ways your apartment can pay:
Housing pays: your property pays MBERG under its own agreement with us. You pay nothing for pickup, and every unit is served whether or not you sign up. Signing up gets you reminders, alerts and extras.
Roommates split: MBERG charges the unit price (currently $40 a month) split evenly between the roommates who join, up to 4. Signing up is optional and never a lease requirement.
MBERG, not your property, provides the service and handles billing, refunds and support. Your property is not a party to these terms and does not guarantee the service.
3. Pickup rules
Put your bin out before 7 PM on pickup nights and bring it back inside by 10 PM, even if it wasn't collected. Florida law limits how long trash may sit in a hallway.
Your bin must stand upright on its own, not leak, have a lid that closes, and hold no more than 13 gallons in indoor hallways (27 gallons in open-air walkways). Set it flat against the wall next to your own door, never blocking a door, hallway, exit, stairs, fire extinguisher or alarm.
Bags must be tied and inside the bin. Never put out hot ashes, cigarettes, batteries, propane, chemicals, liquids or other hazardous items. We don't open bags; you are responsible for what's in them.
You are responsible for where you place your bin and what you put in it, and you agree to cover MBERG for claims caused by your bin. Your property may remove bins or trash left out at other times.
4. Refusals, strikes and disputes
If a bin breaks the rules we skip it, photograph only the bin and bag area (never people), and record a strike for the unit. We text registered residents the reason. At 5 strikes in a calendar month: roommate-paid units are suspended, and each resident who rejoins pays a one-time $15 fee; housing-paid units pause for the rest of the month and restart on the 1st. Strikes reset every month.
You can dispute a strike within 48 hours by text or in the app; we'll review the photo. We share violation records, including photos, with your property manager.
5. Payments (roommate split)
When every roommate has joined, each of you is charged your share for the whole current month, then on the 1st of every month, by card through Stripe. If not everyone joins within 14 days, the roommates who joined can all agree in the app to start with fewer payers; the app shows the new share first. If you join a unit whose service is already running, you pay your full share for the current month right away, whatever the date; that amount is split evenly between the roommates who already paid for that month and comes off their next bill as credit (credit first covers anything owed on that bill; credit left when someone moves out stays on their account and is refunded on request). If a roommate leaves, the others' shares go up from the first bill at least 7 days after we tell you (if the next bill is sooner, it stays the same and the new share starts the month after), and you can leave before then at no cost. We change the monthly price at most once every 12 months, with at least 30 days' notice, and you may cancel before it takes effect.
When you add your card to join a unit, a one-time $10 refundable deposit is charged first and kept as credit on your account. If a monthly share isn't paid within 3 days, the deposit covers it (anything above $10 is added to your next bill) and the deposit is refilled on your next bill. If that next bill isn't paid within 3 days either, you're removed from the unit, one month of your share is added to the next bill of the roommates who pay, and you owe what wasn't paid; once you pay it back, your roommates' part comes off their bill and you can join again. The deposit stays on your account when you leave; ask us any time to refund it.
You can cancel anytime in the app (Home → Leave this unit); cancellations by text, phone or email are not accepted; service continues until the end of the month you paid for. Months already paid aren't refunded, except that if we stop serving your community we refund prepaid time we won't serve.
6. Extras: oversized pickup and cleaning
Oversized pickup is $25, one per resident per month, after we approve a photo. Items you hand over become MBERG's property; we may keep, donate, sell, recycle or dispose of them.
Cleaning is priced by unit size and split between roommates, and every resident of the unit must accept. Extras are charged to your card when we confirm the booking. Cancel more than 24 hours before for a full refund; within 24 hours there is no refund. If we cancel or can't do the job (other than because you canceled or didn't give access), you get a full refund. An MBERG cleaning is not your property's move-out inspection and doesn't guarantee your security deposit.
In housing-paid communities, you pay for extras yourself; your property doesn't.
7. Texts and emails
By adding your mobile number you agree to service texts from MBERG (reminders, refusals, bookings, billing). Message and data rates may apply. Reply STOP to stop texts, HELP for help. Reminders are a courtesy; a missed reminder doesn't excuse a rule violation.
8. When service can't happen
We may skip or delay pickup for severe weather, storm warnings, holidays, locked gates or broken access, a full or broken compactor, emergencies at the property, or anything else outside our control. We'll tell you as early as we can.
9. Limits of our responsibility
We provide the service as described in these terms. We are not responsible for items left outside a bin, or for bins, except for damage caused by our own negligence. To the extent the law allows, our total liability to you is limited to what you paid MBERG in the 3 months before the claim, and we aren't liable for indirect or consequential losses. Nothing here limits rights you have under Florida law that can't be waived.
10. Your account and ours
We may suspend or close accounts for non-payment, abuse of staff, fraud or repeated rule violations. You can stop using the service at any time.
11. Changes to these terms
We may update these terms. For important changes we'll tell you in the app or by email and ask you to accept again before you continue.
12. Law and disputes
Florida law governs these terms. Disputes go to the courts in Hillsborough County, Florida, including small claims court. Please text or email us first; most problems are solved quickly.
